The other day l was trying to make a left turn at a intersection ( note: your allow to enter intersection to make a left turn here in Canada)
Anyways as l prepared to turn and all car had stop at the yellow light this vehicle going through hits my passenger side, as he had went through a red light.

On top of that when the claim adjuster asked him what light was it he said GREEN, however one witness told the police it was yellow, when they were crossing the street. So who will be at fault?? who will the adjuster find in favour?



Moreover, the witness said that it was Yellow while quickly crossing the street, cuz they almost got hit after they finish crossing the street, so assuming it was a red light when he hit me.

It sounds like you will be at fault. If the light was green or yellow the other driver had the right of way. However, if it was Red then the other driver would be at fault.
If the witness said yellow they will probably go with their statement because the Witness has nothing to gain or lose by telling the truth.

When making a left turn, it is imperative and required that you, as the driver, determine all oncoming traffic is clear. Unfortunately, you missed seeing that one car.
These are called ''unprotected'' left turns. One car at at time enters the intersection, wheels straight, and waits until the intersection is clear. When clear, that car completes the turn, even if on a red light. (They entered the intersection on a green light.)

Hi l am going to put ur mind at rest even though i'm from the United Kingdom Britain l would say that it was the other drivers fault because the light was yellow & going to turn red so he/she should have been paying attention. l hope that over there in Canada they give fines as that would have cost someone over here £2,500 & a 2 - 5 year prison sentence. So do not worry they r the ones who will have to pay the price for driving without due care & attention & that is a criminal offence. The color of the light is going to make a big difference on who is at fault. You probly already know that. It sounds like the witness really did not see what color the light was. He was crossing on the yellow & had no idea if the light changed colors or not. That is my guess.

Your accident is difficult. It will depend on if they find the witness believeable & if the witness really knows what color the light was.
Only the claims rep will determine who is at fault. No one here can.

If there is no way of telling then they will consider the accident both of ur faults & rule it 50/50. You r just going to have to wait & see how ur insurance company rules who is at fault. Hopefully, they take ur side.

u failed to yield while turning left if the light was yellow or green. they will likely go with the witness' version so u r at fault for that. the only defense u might have is depending on where they hit u on ur car. did they swerve? they have the duty to take the last clear chance to avoid an accident. did they try to by swerving around u or stopping? did they not pay attention & hit you? if they hit the rear of ur car they should have seen u & should have been able to avoid or stop. if they hit the front, u probably turned to sudden for them to really react. that may be ur only argument. the adjuster will make his decision. u can try to argue with him if u do not like it however he may or may not change anything. he may deny ur claim or may offer u 20% of ur damages or pay u all.
