My wife recently got into a car accident. She tried going to work, but slight injury to her spine led to her having it checked to the hospital. They put her out of work. The lawyer told her that she needs to stay 90 days out of work in order to sue. She has been out of work for about a week so far. She is bored at home and needs the money, and wants to go back to work and see if she can physically work again. If she isnt and is sent out of work again, will we have to count 90 days again, or does that previous week she didnt work before she went back to work count towards the 90 days?
The hospital is paying for her medication and physiotherapy. She lost a promotion and is closed to getting fired as she is out of work. she wants to go back and tried to go back, but left in pain many days. The medication are those drowsy strong dose ones, as she has 4 bulging spinal discs.

If she was hit by some one then why does not she contact their insurance company to get compensated for the hospital bills and lost wages? Or does she just want to get rich now?

The best thing to do is to check with the attorney, but l think the 90 day clock may start over again if your wife returns to work.

l am not sure what state you're in but some of this does not sound right for me. If ur wife was in an accident the insurance company owes for the medical bills & lost wages & pain/suffering. I've not heard of a 90 day limit for something like this. Her doctor will have to provide a disability note as to why she was unable to work for 90 days. If she is unable to work for 3 months this is a pretty serious accident. & should be more than just soft tissue injuries. The last thing an attorney really wants to do is sue an insurance company. althought they can & will, they want to settle the claim. The insurance company will not settle the claim until ur wife is done treating.

Have u checked into filing a claim under ur own policy. Most states offer PIP or Med Pay that will assist with the medical bills & lost wages as u accrue them.

Your attorney should really be doing a better job of keeping ur informed especially since he is taking 1/3 of what you're going to get. if u go to court it becomes 1/4.

Also if ur wife works for a company has she looked into filing FMLA which helps protect ur job when you're out of work due to a medical condition.
