Can l sue for half of a vehicle deductible if my insurance company already went after the party (uninsured) and negotiated with them.
My insurance company sent me back half of my deductible.
Can l sue (and win!) for the rest of the deductible?
My one friend says no...something about suboragation within the insurance contract.But l can not find information on that.

l expect since you have already settled the best thing would be take what you got and be happy. If you sued you would not get any more because it is a ''dead issue'' in the eyes of the law.

Anyone can sue anybody at any time for anything. Who would you sue? Your insurance company already negotiated (subrogated) for you. Sue if you like but in my opinion it would be a waste of your money and the courts time and would cost far more than your half of the deductible.

You can go through small claims, your choice. It is completely separate from your insurance contract. As long as your not going to try to get from your insurance carrier.
